LICENCE AGREEMENT
1. Scope of Licence
1.1 BBC Worldwide Limited ("the Owner") hereby offers you a non-exclusive personal licence to use and display this CD-ROM on a single computer and a single screen on the terms set out below.
1.2 You may not load or install this software ('the Software') into any computer or copy it without the licence of the Owner.
1.3 You may not install or otherwise use the Software on any computer or system which permits electronic access to it by more than one user.
1.4 None of the material contained in the CD-ROM either in whole or in part, may be copied onto hard disk except for its set-up program which may not be installed on more than one computer at any time.
1.5 All rights not expressly granted to you under this agreement are expressly reserved to the Owner.
2. Copyright
2.1 The copyright in this software ("the Software") is owned by the Owner.
2.2 The CD-ROM on which the Software is recorded contains recordings of audio, video and still photographic materials (the "BBC Materials"). Copyright in the BBC Materials is owned by or is licensed to the Owner or the British Broadcasting Corporation. For the purpose of this Agreement, the BBC Materials are considered to form part of the Software.
3. Warranties
3.1 The Owner warrants that the CD-ROM on which the Software is supplied will be free from defects in materials and workmanship under normal use for a period of 90 days after the date of original purchase ("The Warranty Period"). If a defect in the compact disc shall occur during the Warranty Period you may return it with proof of purchase to the Owner who will replace it free of charge.
3.2 The Owner warrants that the Software will perform substantially in accordance with its accompanying documentation (provided that the Software is properly used on a computer matching or exceeding the specifications appearing on the packaging of the Software) and if the Software fails to so perform you may return it with proof of purchase and the original packaging to the Owner who will provide or authorise a refund of the price of the Software.
3.3 The express terms of this Agreement are in lieu of all warranties, conditions, undertakings, terms and obligations implied by statute, common law, trade usage, course of dealing or otherwise all of which are hereby excluded to the fullest extent permitted by law.
4. Exclusions and Limitations
4.1 The Owner makes no warranties or representations either express or implied in relation to the Software and its associated documentation, including but not limited to implied warranties of completeness, accuracy, merchantability and fitness for a particular purpose. You accept that the Software and its associated documentation are provided on an "as is" basis.
4.2 You shall load and use the Software at your own risk and in no event will the Owner be liable to you (except for personal injury or death resulting from the Owner's negligence) including lost profits or other consequential loss arising from your use or inability to use the Software or from errors or deficiencies in it whether caused by negligence or otherwise except as expressly provided herein. The Owner's liability to you for any losses shall not exceed the amount you paid for the software.
5. Termination
This Agreement shall automatically terminate, without notice from the Owner, if you fail to comply with any provisions of the Licence. Upon termination you agree to destroy the CD-ROM on which the Software is recorded and to erase any part of the Software stored on the hard disk of the computer under your control.
6. Restrictions on Use
6.1 Except as expressly authorised herein you shall not rent, lease, sub-licence, install on or transmit across any local or wide area network, loan, copy (save to the extent that installation of the Software and its subsequent use involves the copying of part of the Software onto the hard disk of the computer on which it is used), modify, adapt, merge, translate, reverse engineer, decompile, disassemble or create derivative works based on the whole or any part of BBC Materials, the Software and its associated documentation.
7. Applicable Law
7.1 This Agreement shall be governed by the laws of England and Wales.
7.2 In the event that any provision of this Licence shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, such provision will be enforced to the maximum extent permissible and the remaining portions of this Licence shall remain in full force and effect.
Epilepsy Warning
A small number of people are liable to have an epileptic seizure or lose consciousness when exposed to flashing natural or artificial lights. Such persons may also be at risk when watching images displayed on a computer monitor.
If you or any potential user of this software has ever shown symptoms similar to the above when exposed to flashing lights, then please seek medical advice prior to installing this product. Please remember to avoid eye and muscle strain and take at least a ten-minute break every hour.
